Terms of Use

1. Who We Are

The Site is published by Peters & Associates, Inc., a licensed real estate brokerage in the State of North Carolina, regulated by the North Carolina Real Estate Commission. “The Peters Team” is a marketing designation for a team of licensed agents operating within and under the supervision of Peters & Associates, Inc. It is not a separate legal entity, corporation, or independent brokerage.

2. Eligibility

You must be at least 18 years of age and legally able to form a binding contract to use the Site. The Site is not directed to children under 13, and we do not knowingly collect information from them.

3. Informational Use Only; No Professional Advice

The Site is provided for general informational and marketing purposes. Nothing on it constitutes legal, tax, financial, investment, insurance, appraisal, engineering, or mortgage advice, an offer, or a solicitation where prohibited.

Using the Site, submitting a form, or corresponding with us does not create an agency, fiduciary, or broker-client relationship. Such a relationship arises only under a written agreement signed by you and Peters & Associates, Inc. In the event of any conflict between the Site and a signed agreement, the signed agreement controls.

4. Accuracy Disclaimer

We make good-faith, reasonable efforts to publish accurate and current information, and we correct errors when we learn of them. We do not, however, warrant that any content is complete, accurate, current, or error-free. Listing data, market statistics, valuations, school information, tax figures, and third-party content are provided “AS IS” without warranty of any kind.

Our full accuracy, property-data, valuation, forecast, and third-party disclaimers are set out on our Disclaimers page and are incorporated into these Terms by reference.

5. Acceptable Use

You agree not to:

• Use the Site for any unlawful, fraudulent, harassing, or infringing purpose.
• Scrape, crawl, harvest, data-mine, frame, mirror, or systematically download Site content or listing data.
• Use Site content to train commercial machine-learning or generative models without prior written permission.
• Attempt to gain unauthorized access to, probe, disable, or interfere with the Site, its servers, or its security features.
• Introduce malware, automated agents, or excessive automated traffic.
• Submit false, misleading, or third-party personal information without authorization.
• Remove, obscure, or alter any proprietary notice.

6. Intellectual Property

All content on the Site — including text, photography, video, graphics, logos, market analysis, compilations, page design, and code — is owned by or licensed to Peters & Associates, Inc. and protected by United States and international intellectual property law.

You are granted a limited, revocable, non-exclusive, non-transferable license to view and print limited portions of the Site for personal, non-commercial use only. All other rights are reserved. Copyright complaints are handled under our DMCA & Copyright Policy.

7. Submissions and Communications Consent

By submitting your name, phone number, or email through any form on the Site, you consent to be contacted by Peters & Associates, Inc. by phone, text message (SMS), and email regarding your inquiry and related real estate services, including through automated means where permitted. Consent is not a condition of purchase. Message and data rates may apply. Reply STOP to opt out of texts or use the unsubscribe link in any marketing email.

Any non-personal content you submit (such as feedback, suggestions, or reviews) may be used by us without restriction or compensation. You represent that you own or have the right to submit anything you provide.

8. Third-Party Content, Links & Referenced Companies

The Site links to and may embed third-party services, including multiple listing service search tools, maps, video players, analytics, and affiliated Peters-family brands. References to vendors, contractors, designers, builders, or “partners” are descriptive and do not create a partnership, joint venture, agency, or shared liability.

We do not control and are not responsible for third-party content, services, pricing, privacy practices, or performance. Your dealings with any third party are solely between you and that party.

9. Fair Housing

10. Privacy

Your use of the Site is also governed by our Privacy Policy and Cookie Policy, which describe what information we collect, how we use it, and the choices available to you.

11. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant uninterrupted, secure, or error-free operation.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PETERS & ASSOCIATES, INC., THE PETERS TEAM, AND THEIR OWNERS, OFFICERS, BROKERS, AGENTS, EMPLOYEES, CONTRACTORS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITY, ARISING FROM OR RELATED TO THE SITE.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100.00).

Where applicable law does not permit certain limitations, those limitations apply to the fullest extent permitted, and nothing here limits liability that cannot lawfully be limited.

13. Indemnification

You agree to indemnify, defend, and hold harmless Peters & Associates, Inc. and its owners, officers, brokers, agents, and employees from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your breach of these Terms, or your violation of any law or third-party right.

14. Dispute Resolution, Arbitration & Class Waiver

The parties will first attempt in good faith to resolve any dispute informally by contacting us at npeters@petersteamrealty.com. If not resolved within 30 days, any dispute arising out of or relating to the Site or these Terms shall be resolved by final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Mecklenburg County, North Carolina, before a single arbitrator.

TO THE EXTENT PERMITTED BY LAW, DISPUTES WILL BE ARBITRATED ONLY ON AN INDIVIDUAL BASIS. YOU AND WE WAIVE ANY RIGHT TO A JURY TRIAL AND ANY RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.

Either party may bring an individual claim in small claims court. Nothing in this section limits either party from seeking injunctive relief for intellectual-property misuse. If the class waiver is found unenforceable, this arbitration section shall be void as to the affected claim.

15. Governing Law and Venue

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Subject to the arbitration section above, exclusive venue lies in the state and federal courts located in Mecklenburg County, North Carolina, and you consent to personal jurisdiction there.

16. Time Limit on Claims

To the extent permitted by law, any claim arising out of or related to the Site must be filed within one (1) year after the claim arose, or it is permanently barred.

17. Changes, Suspension & Termination

We may modify these Terms or any part of the Site at any time without notice. Changes take effect when posted, and your continued use constitutes acceptance. We may suspend or terminate access to the Site for any reason, including suspected violation of these Terms.

18. Severability, Waiver & Entire Agreement

If any provision is held unenforceable, it shall be limited or severed to the minimum extent necessary and the remaining provisions remain in full force. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy, Cookie Policy, Disclaimers, DMCA Policy, Fair Housing statement, and Accessibility Statement, constitute the entire agreement regarding the Site.
